This website is operated by TCMConcierge (ABN 67 930 973 383) trading as La Concierge™ ("La Concierge" or "us") under the domain name "www.laconcierge.com.au" ("Website").

If you do not agree with the Terms and Conditions or Privacy Statement you should not use the Website.

Interactive functionality

1. The interactive member section of the Website is only available for use by authorised La Concierge members. LaConcierge offers the following services ("Services") to La Concierge members:
   1. access to view a member's own personal details;
   2. ability to change a member's contact details held by La Concierge;
   3. access to view member profiles;
   4. access to information  

Confidentiality

1. Members must use a password and member username to enable them to use the Services. Members agree that:
   1. they will not send or disclose their password to any other person;
   2. they will not keep their password in any form, whether encoded or unencoded, in a location where it is capable of being copied or used by any person other than the member;
   3. the member is solely responsible for any loss caused by use of their password by them or any other person; and
   4. the member is responsible for any access to the Services as a result of using their password, including any use not approved or contemplated by that member.
2. A member must immediately notify La Concierge if they know that their password has been compromised or become known to a third party, or if they know of any unauthorised use of their password.
3. When logging on to the Website to use the Services, a member will be allowed 3 attempts to enter their password. After the third failed attempt to enter their password they will be temporarily denied access to the Services.

Fee for the Service

La Concierge charges fees for members use of applicable Services as stated and can be updated without notice.

System integrity

When using the Website a member must not use any device, software or routine to interfere with the proper working of the Website or any activity conducted by La Concierge. A member must not take any actions which imposes an unreasonable or disproportionate load on La Concierge's infrastructure.

Indemnity

A member agrees to defend, indemnify and hold harmless La Concierge and its related officers and employees, from any and all liabilities, costs and expenses, including reasonable legal fees related to any violation of the Terms of Use by a member or users of a member's details, or in connection with the use of the Website or the placement or transmission of any Content by a member or users of a member's details.

Disclaimer

Information, content and material on the Website ("Content") is provided in good faith. However, to the extent permitted by law, no warranty as to accuracy or completeness of Content is given. LaConcierge does not guarantee that our Website will be free from viruses, or that access to our Website will be uninterrupted.

No responsibility is accepted by LaConcierge or its employees for any loss or damage arising from reliance on Content. No person should act on the basis of any Content without taking appropriate professional advice about their particular circumstances.

The Website may contain links to websites operated by third parties ("Linked Websites"). We do not have any input into or control over information, products or services on Linked Websites. Accordingly, to the extent permitted by law, LaConcierge takes no responsibility and makes no warranties in respect of any information, products or services which may appear on any Linked Websites.

Liability

Subject to obligations implied by law and which cannot be excluded, La Concierge is not liable to a member for any losses, damages, liabilities, claims and expenses (including but not limited to legal costs and defence or settlement costs) whatsoever arising out of or referable to Content or our Website whether in contract, tort including negligence, statute or otherwise.

La Concierge's liability for breach of any condition or warranty implied by law and which cannot be excluded, is limited to the maximum extent permitted by law.

Copyright and Trade Marks

All Content is copyright and is owned or licensed by La Concierge, unless expressly indicated otherwise. Other than as permitted under the Copyright Act 1968 (Cwlth), no part of this site may, in any form or by any means, be reproduced, stored in a retrieval system or transmitted without prior written permission. Inquiries or application for permission to use Content for other purposes should be directed to the office of La Concierge. La Concierge and Your Business Matters is trade marked in Australia and New Zealand and owned by Teresa Mitchell.

General

This Website is provided for use by Australian and New Zealand residents only. The applicable law to the use of the Website and to disputes arising out of the Website is the law of the State of Victoria, Australia.

The agreement set out in these Terms of Use and your access to the Website may be terminated by us at any time without notice. All restrictions, licences granted by you and all disclaimers and limitations of liability by La Concierge will continue after termination.

These are the current Terms of Use and they replace any other terms of use for our Website published on our Website to date. We may at any time amend the Terms of Use by publishing the varied Terms of Use on our Website. You accept that by doing this, La Concierge has provided you with sufficient notice of the amendment.
